Actor Raul Julia's Son Tells His Story about Exhumation Request for His Father
(ContentDesk) April 20, 2006 -- Raul Julia-Levy, the first-born son on the late actor Raul Julia, wants his side of the story told. The late actors widow Merel Poloway sullied Julia-Levys name in The New York Times. According to Julia-Levy, CBSs The Insider aired a truncated interview with him that did not clarify the facts. All Julia-Levy wants is to dispel the comments Poloway made in newspapers and on television and to address the circumstances surrounding the requested exhumation of his fathers body.
According to Julia-Levys publicist Laura Holk, The dispute between Julia-Levy and Poloway has privately ensued for over 10 years and was brought to the publics attention in The New York Times by an interview initiated by Poloway. ???Although The Insider interviewed Julia-Levy for three hours, only five minutes of the interview aired on television. On The Insiders website, Poloway states that she has made every attempt to resolve the situation reasonably and still hopes to do so.
???Julia-Levy disagrees with Poloways contention that she has been trying to resolve the situation. It has been 10 years and it is within the last month that she has contacted my attorney. I have never objected to a paternity test. In fact, I contacted the most reputable DNA centers and established an account with the DNA Diagnostic Center, said Julia-Levy to The Insiders reporter.???In a letter from Poloway's lawyer, Poloway suggests using a 13-year preserved tissue block from the late actor or a Y chromosome test with Julia-Levys two half brothers for resolving the paternity dispute. Julia-Levys attorney John DeHart researched each option and said that the only viable paternity test is called a legal paternity test that follows a chain of custody.???According to scientists at the DNA Diagnostic Center, the chain of custody requires that the samples have to be carefully collected by a neutral third party, under the strictest supervision.???The DNA Diagnostic Center also refuted the viability of the 13-year old sample. Due to the extended time period of storage (over 13 years) the DNA contained in this sample would certainly be diminished, if present at all, stated the Center in a letter to Julia-Levy.
Given the storage condition and the age of the said sample, it is highly unlikely to obtain sufficient, non-degraded, and viable DNA for subsequent paternity testing. The DNA Diagnostic Center advised Julia-Levy to avoid taking a Y chromosome test because it is not a legal paternity test and the results are inconclusive, meaning that it will not be admissible for legal purposes. According to the DNA Diagnostic Center, the paternity of Julia-Levys two half brothers would also have to be established through a legal paternity test.On The Insider, Julia-Levys attorney DeHart said, The only way to prove Raul Julia-Levys paternity is to exhume Raul Julias body. During the same interview with The Insider, Julia-Levy said that the DNA Diagnostic Center has found usable samples on bodies that have been buried for 17 years. He stated that he feels it is sacrilegious to exhume a body. But to protect his rights, this is the only viable option. DeHart stated that he has found that 99% of legal paternity tests cannot be carried out unless the laboratory performing the test has received a sample from the mother, the child and the alleged father.
A petition to exhume Raul Julias body has been filed and is being considered by the Supreme Court in Puerto Rico. Julia-Levy is not seeking financial reward. I only want declaratory relief and to go on with my acting career, said Julia-Levy, who will begin a couple movies in late July. Talks are currently underway to form the Slim-Levy Entertainment Group that would provide a hundred million dollars in funding for independent films in Hollywood.
